Welcome to imontour.com (“ImOnTour”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of:

2. Eligibility

If you use the Service on behalf of a band, venue, agency, company, or other organization, you represent that you have authority to bind that entity to these Terms. In that case, “you” and “your” refer to both you personally and that entity.


3. Account Registration & Security

To access certain features, you may need to create an account.

You agree to:

  • Provide accurate, current, and complete information when creating your account and profile.
  • Keep your login credentials confidential and not share your account with others.
  • Notify us promptly if you suspect unauthorized access to your account.

You are responsible for all activities that occur under your account.

We reserve the right to refuse registration, suspend, or terminate accounts at our discretion, including if we believe you have violated these Terms.


4. Profiles & Public Information

ImOnTour is designed for public-facing profiles for bands, venues, agents, promoters, and other touring professionals.

  • Information you choose to include on your public profile (e.g., display name, role, city/region, links, bio, photos, tour details) may be visible to other users and visitors.
  • Think carefully about what you share publicly. Do not post sensitive personal information that you do not want others to see.

You are solely responsible for the accuracy and content of your profile.


5. User Content & License

User Content” means any content you submit, upload, post, or otherwise make available through the Service, including:

  • Profile information, text, bios, and descriptions
  • Photos, logos, and images
  • Event/tour details and routing information
  • Messages or communications sent through the Service (to the extent permitted by the platform)

5.1 Your Responsibilities

You represent and warrant that:

  • You own or have the necessary rights to all User Content you submit.
  • Your User Content does not infringe or violate any third-party rights (e.g., copyrights, trademarks, privacy, publicity) or any laws or regulations.
  • Your User Content is not deceptive, fraudulent, hateful, harassing, obscene, or otherwise unlawful or harmful.

You are solely responsible for your User Content and any consequences of posting or sharing it.

5.2 License You Grant to ImOnTour

By submitting User Content, you grant ImOnTour a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to:

  • Host, store, use, reproduce, modify (for formatting or technical purposes), adapt, publish, translate, distribute, display, and perform such User Content in connection with operating, promoting, and improving the Service.

This license continues for as long as your User Content is on the Service. Certain copies (e.g., backups, cached or archived content) may remain for a reasonable period even after deletion, to the extent permitted by law.

We will not sell your personal data as “User Content,” but public profile content may be indexed, displayed, and used in ways inherent to a public networking platform.


6. Prohibited Conduct

You agree that you will not:

  1. Use the Service for any illegal purpose or in violation of any law or regulation.
  2. Impersonate any person or entity, or misrepresent your affiliation with a band, venue, agency, or organization.
  3. Post or transmit any content that is:
    • Infringing, defamatory, abusive, harassing, threatening, hateful, or discriminatory
    • Pornographic or sexually explicit
    • False or misleading in a way that causes harm
  4. Engage in spam or unsolicited promotions, including mass messaging other users.
  5. Scrape, crawl, or use automated means (bots, scripts, etc.) to access or collect data from the Service without our written permission.
  6. Attempt to circumvent security measures, probe or test vulnerabilities, or disrupt the Service’s operation.
  7. Reverse engineer or decompile any part of the Service except where permitted by law.
  8. Use the Service to solicit, encourage, or engage in illegal activities or unsafe events.

We may investigate and take appropriate action (including account suspension or removal of content) if we believe you have violated these Terms.


7. Messaging & Communication Between Users

The Service may allow users to contact each other (e.g., bands contacting venues, agents contacting bands).

  • ImOnTour is not a party to any agreements or communications between users.
  • We do not control or endorse the content of user-to-user communications.
  • You are responsible for your interactions with other users. Exercise common sense and caution, especially when arranging in-person meetings, financial transactions, or tour agreements.

8. Bookings, Deals, and Financial Arrangements

ImOnTour is a networking platform, not a booking agency.

  • We do not guarantee any shows, tours, payments, or outcomes.
  • We are not responsible for negotiations, contracts, payments, cancellations, disputes, or any other arrangements between bands, venues, promoters, or agents.
  • Any terms you agree to with other users (e.g., guarantees, splits, hospitality, riders, production requirements) are strictly between you and them.

You are solely responsible for:

  • Conducting your own due diligence
  • Entering into written agreements where appropriate
  • Complying with applicable laws (e.g., tax, labor, safety, licensing)

9. Fees & Payments

At this time, some or all features of ImOnTour may be provided free of charge, but we reserve the right to:

  • Introduce paid features, subscriptions, or premium tiers in the future.
  • Modify pricing or payment terms with reasonable notice.

If paid features are introduced, separate terms (e.g., billing, refunds, cancellation) may apply and will be made available to you.


The Service may include links to third-party websites or services (e.g., social media, ticketing platforms, streaming sites).

  • ImOnTour does not control or endorse these third-party services.
  • We are not responsible for their content, policies, or practices.
  • Your use of third-party sites is at your own risk and subject to their terms and privacy policies.

11. Intellectual Property of ImOnTour

All rights, title, and interest in and to the Service (excluding User Content) are owned by or licensed to ImOnTour, including:

  • Logos, branding, and trademarks
  • Software, code, databases, and functionalities
  • Text, graphics, and other non-user content

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose, subject to these Terms.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code, except where laws prohibit these restrictions.


If you believe that content on ImOnTour infringes your copyright, you may send us a notice that includes:

  2. Identification of the material you claim is infringing, with enough detail for us to locate it.

We do not endorse or guarantee any band, venue, agent, promoter, event, or other user listed on the Service.

You use the Service at your own risk.


14. Limitation of Liability

To the fullest extent permitted by law:

  • ImOnTour and its owners, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
    • Your use of or inability to use the Service
    • Any conduct or content of other users or third parties
    • Any content obtained through the Service
    • Unauthorized access, use, or alteration of your transmissions or content

In no event shall ImOnTour’s total liability for all claims relating to the Service exceed the greater of:

  • The amount you paid us, if any, for access to the Service in the twelve (12) months prior to the event giving rise to the claim, or
  • $0.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.


15. Indemnification

You agree to indemnify, defend, and hold harmless ImOnTour and its owners, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another person or entity (including intellectual property or privacy rights)
  • Your interactions or dealings with other users (bands, venues, agents, promoters, etc.)

16. Termination

We may suspend or terminate your access to the Service, or remove any User Content, at any time and for any reason, including if we believe:

  • You have violated these Terms,
  • You pose a risk to other users or to the platform, or
  • We need to protect the security or integrity of the Service.

You may stop using the Service at any time. You can also request account deletion as described in our Privacy Policy.

Upon termination:

  • Your right to access and use the Service will end.
  • Certain provisions of these Terms will survive, including those relating to intellectual property, disclaimers, limitation of liability, and indemnification.

17. Governing Law & Dispute Resolution

These Terms and any dispute or claim relating to them or the Service will be governed by and construed in accordance with the laws of:

the State of Texas, USA, without regard to its conflict of law principles.

Any disputes arising under or in connection with these Terms shall be resolved in the courts located in:

Harris County, Texas, USA.

unless applicable law requires a different jurisdiction.

You agree to submit to the personal jurisdiction of such courts and waive any objections based on inconvenient forum.
